Terms of Use and Sale

Last updated: October 07, 2026

These terms govern access to and use of the BeOnStage platform, as well as the sale of the services offered on the website and the mobile application.

This translation is provided for information only; the French version prevails in the event of any discrepancy.

Publisher identification

The be-on-stage.com website and the BeOnStage mobile application (hereinafter "the Platform") are published by BE ON STAGE, a simplified joint-stock company (SAS) with a share capital of €10,000, registered under SIREN number 108 138 140, whose registered office is located at 22 avenue Pierre 1er de Serbie, 75116 Paris, France (hereinafter "the Company" or "BeOnStage").

  • EU VAT number: FR66108138140
  • Publication director: BE ON STAGE
  • Contact: contact@be-on-stage.com (no dedicated support phone line at present; reachable by email only)
  • Infrastructure hosting provider: to be completed: hosting provider's company name, legal form, registered office address and phone number
  • Storage and delivery of files uploaded by users (photos, audio, videos, live streams): Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, United States.

1. Purpose and scope

1.1 These general terms of use and sale (hereinafter the "Terms") apply to all services made available to the public by the Company on the be-on-stage.com website and on the BeOnStage mobile application, available on the App Store (iOS) and on Google Play (Android).

1.2 The purpose of the Platform is to connect:

  • musicians who publish their creations (hereinafter the "Artists");
  • users who discover, listen to and follow these Artists (hereinafter the "Fans");
  • music professionals — labels, managers, producers, distributors, etc. — who scout for talent (hereinafter the "Professionals" or "Talent Scouts").

Any person using the Platform, in any capacity whatsoever, including without an account (viewing the public discovery feed on the website), is hereinafter referred to as "the User".

1.3 A single account may combine several capacities (for example Artist and Fan). Certain features are reserved for a given capacity (see article 4).

1.4 The Platform is reserved for natural persons. Accounts are strictly personal and may not be transferred. The Company reserves the right to offer specific terms to Professionals acting on behalf of a legal entity; such Professionals are treated as professionals within the meaning of consumer law (see article 14), without a separate contract being required.

2. Acceptance and amendment of the Terms

2.1 The Terms take effect upon creation of an account. The User accepts them, together with the Privacy Policy, by ticking the boxes provided for this purpose during registration: at the "personal information" step for an Artist or a Fan, and at the "Terms of Use / Terms of Sale" step for a Professional. The date and time of this acceptance are recorded.

2.2 The Company reserves the right to amend all or part of the Terms at any time. The applicable Terms are those published on the Platform at the time the service is used or the order concerned is placed. Any substantial amendment is brought to the User's attention by email or in the application with 30 days' notice; continued use constitutes acceptance. A User who refuses the new Terms may delete their account.

3. Registration, authentication and account

3.1 Account creation

Access to the features of the application requires the creation of an account using an email address. The User then provides the requested information, which varies according to the profile chosen:

  • Fan: nickname (3 to 20 characters), profile picture, favorite music genres, then first name, last name, date of birth, city and country;
  • Artist: artist name, biography, profile picture, music genres, links to their social networks (Instagram, TikTok, YouTube, Spotify, Discord), then first name, last name, date of birth, city and country; the Artist states whether they consider themselves an amateur or a professional;
  • Professional: the account is created by the Company by invitation (see 3.5); the Professional then completes their occupation(s) (two at most), their organization, their distributor where applicable, a description, their music genres, their references and a presentation video.

A mobile phone number may be associated with the account; it is used in particular to recover the account if access to the email address is lost (see 3.4).

3.2 Passwordless authentication

Authentication takes place without a password, by means of a single-use sign-in link sent to the declared email address and valid for 15 minutes. When the link is opened on a device on which the application is not installed, a web page displays a QR code to be scanned from the device on which the email address was entered. Once signed in, the device remains authenticated for a maximum of one year without any further action by the User, unless they sign out or are suspended.

The User is solely responsible for the confidentiality of their inbox and their devices, and for any action carried out from their account. They shall inform the Company without delay of any unauthorized access.

3.3 Accuracy of information

The User guarantees that the information provided is accurate, complete and kept up to date, in particular their date of birth, which determines the application of the rules relating to minors. The Company cannot be held liable in the event that incorrect information is used.

3.4 Changing the email address or phone number, account recovery

Any change to the email address or phone number associated with the account is subject to a dual-channel confirmation procedure: a link sent to the new address (or a code sent by SMS to the new number) must be combined with the application session. When the email address is changed, the former address is notified. The request expires after 15 minutes.

A User who no longer has access to their email address may recover their account using their mobile number: a single-use code is sent to them by SMS, valid for 5 minutes and 5 attempts. The new email address must then be confirmed by a sign-in link.

3.5 Professional accounts

Professional accounts are created by the Company after verification to be completed: criteria and procedure for verifying Professionals (documents requested, timeframe, grounds for refusal) . The Professional receives an invitation email informing them of the address to use to sign in. The Company may refuse or withdraw Professional status at any time, in particular in the event of abusive solicitation of Artists.

3.6 Minors

The Platform is open to persons aged at least 13. Users under the age of 18 are considered minors.

The registration of a minor under the age of 15 requires the prior authorization of their legal representative, obtained by means of an online form whose link is sent by email to the designated representative (first name, last name, email address separate from the child's, relationship to the child). On this form, the legal representative declares their capacity, consents to the processing of the child's data and accepts these Terms on their own behalf and on behalf of the child. A certificate in PDF format is provided to them and to the child. Until authorization has been granted, the minor's registration cannot be completed. In the event of refusal, the child is informed and the account is not activated.

The legal representative may withdraw their authorization at any time and request deletion of the account by writing to contact@be-on-stage.com.

4. Description of the services

4.1 Features by profile

Depending on their capacity, the User may in particular:

  • Artist: publish audio, video and photo content as well as events; broadcast video live streams (Premium plan, see article 9); build a community of Fans; view their weekly audience statistics; be spotted by Professionals;
  • Fan: discover content in personalized feeds, listen to it, like it (three levels of appreciation), share it, follow Artists and view their profiles;
  • Professional: browse the profiles of Artists subscribed to the Premium plan, spot them, access their statistics and social networks, publish events and present their professional references.

The discovery feed can also be viewed without an account on the website, for the purpose of presenting the service; full playback and interactions require the application.

4.2 Publishable content

Content may be audio, video, image, live stream or event. It has a title, a description and, except for images and events, one or more music genres. Videos and live streams are transcoded and delivered by a specialized provider (Cloudflare Stream). An event may specify dates, an address, a price and an external link. An Artist's first publication cannot be a mere image. Published content is public and visible to all Users, including without an account on the website via a share link.

Professionals may only publish events. Fans do not publish content.

4.3 Spotting by Professionals

A Professional may "spot" an Artist ("validated" status), "skip" them or "reject" them. An Artist may be spotted by no more than three Professionals at the same time; beyond that, spottings are put on hold and are not counted until a place becomes available. Spotting gives the Professional access to the Artist's cumulative counters and allows them to follow the Artist's publications; for the Artist, it earns a temporary visibility boost in the discovery feeds. The Artist is informed of each spotting.

Spotting does not in itself create any contractual commitment between the Artist and the Professional; the Company is not a party to any relationship they may form outside the Platform, and acts only as a mere technical intermediary, without receiving any commission or imposing any non-circumvention clause.

4.4 Content feeds and ranking

The order in which content is presented in the feeds results from automated criteria: the Artist's weekly performance score (listens, likes, shares, profile visits, new followers), progress from one week to the next, the User's follows and visits, recency, selected music genres, and recent spottings. New Artists receive a starting score in the week of their registration. The weightings may change at any time in order to improve the service; the Artist can view the details of the coefficients applied to their own statistics. The discovery feeds do not display image content.

4.5 Counters and statistics

The Platform counts, per content item and per Artist, listens (from 60 seconds of listening), views, shares, likes by level, followers and profile visits. These counters are visible to other Users, to an extent that depends on their capacity. An Artist's cumulative totals are career totals and do not decrease when content is deleted.

4.6 Notifications

The User receives notifications in the application and, if they have enabled them, push notifications on their devices (new publication by a followed or spotted Artist, spotting, "love", share, new follower, an Artist's progress, moderation decisions). Certain moderation-related notifications are also sent by email. Push notifications can be disabled in the device or application settings; commercial information emails require separate consent, which may be withdrawn at any time.

4.7 Changes to the services

The Company may add, modify or remove features at any time. It informs Users of any significant removal of an essential feature and, for paid services, applies the consequences provided for in article 9.

5. User's undertakings

5.1 The User undertakes to use the Platform fairly and to comply with the laws and regulations in force. The following are prohibited in particular:

  • publishing infringing content or content that infringes the rights of third parties (copyright, related rights, image rights, trademarks);
  • sexual content, hateful, discriminatory or harassing content, violent or abusive content, content endangering minors, and content relating to suicide or self-harm — the reporting grounds offered in the application;
  • defamatory or misleading content, or content that undermines human dignity;
  • identity theft, the creation of multiple or automated accounts, and the use of a confusing artist name or nickname;
  • any artificial manipulation of the counters of listens, views, shares, likes, followers or profile visits;
  • the systematic extraction or reuse of the Platform's content and data, in particular by automated scraping;
  • any attempt to undermine the security, integrity or availability of the service, including circumventing the rate limits in place;
  • for Professionals, any abusive or misleading commercial solicitation of Artists, in particular Artists who are minors.

5.2 The Artist is solely responsible for the live streams they broadcast; the Company exercises no prior control over a live broadcast. The broadcasting credentials provided to them are personal and confidential.

5.3 Information that a User chooses to make public (artist name, nickname, photo, biography, social networks, city) is made public under their own responsibility. Professionals have access to the city, country, social networks and minor status of Artists subscribed to the Premium plan.

5.4 Users' personal contact details remain hidden from Professionals. They may be passed on to a Professional in one case only: where the Professional declares that they have signed a contract with an artist and the User who follows that artist expressly consents, under the conditions described in the Privacy Policy. This consent is freely given, may be withdrawn at any time, and its absence constitutes refusal.

6. Published content and license

6.1 The User retains all intellectual property rights in the content they publish. They guarantee that they hold all the rights and authorizations necessary for its distribution, in particular from co-authors, performers, producers, publishers, collective management organizations and persons depicted, and indemnify the Company against any claim in this respect.

6.2 Solely for the purposes of operating the Platform, the User grants the Company a non-exclusive, royalty-free, worldwide license, for the period during which the content is published, to host, reproduce, adapt to the necessary technical formats (transcoding, thumbnails, excerpts, recording of live streams for replay), perform and distribute the content within the Platform, on the website accessible without an account, and in its communications promoting the service published on the official BeOnStage social networks, with credit to the Artist or the source content; the User may object to this at any time (opt-out) from their account settings.

6.3 A live stream broadcast by the Artist is recorded and made available for replay on the Platform under the same license, unless the Artist deletes the content.

6.4 This license ends upon deletion of the content or the account, subject to temporary technical copies, backups and legal retention obligations.

6.5 Content is not monetized by the Company and does not give rise to any revenue sharing with Artists, with the exception of financial support from Fans (CLAPS) described in article 9.7.

7. Reporting, moderation and sanctions

7.1 The Company acts as the hosting provider of the content published by Users. It does not carry out general monitoring but promptly removes any manifestly unlawful content that is duly reported to it.

7.2 Any content or profile (Artist, Fan, Professional) may be reported from the application, by selecting one of the grounds offered and providing a description, or by email to contact@be-on-stage.com. A User may report the same target only once. Each report is given a reference, communicated to the reporter, to be quoted in any exchange with support.

7.3 Handling of reports:

  • the person concerned is informed of the report;
  • where the same content or profile is the subject of three reports that have not been rejected, it is automatically suspended as a precautionary measure pending human review; the person concerned is informed by notification and by email;
  • each report is reviewed by the Company's moderation team, which validates or rejects it and gives reasons for its decision, in principle within 48 hours;
  • if the report is validated, the content is unpublished or the account suspended; if it is rejected, any precautionary suspension is lifted; the reporter and the person concerned are informed of the decision.

7.4 Reporting a profile may result in the suspension of the account as a whole, including the User's other capacities. A suspended account can no longer access the application and its content is no longer visible.

7.5 Depending on the seriousness and repeated nature of the breaches, the Company may unpublish content, restrict access to certain features, suspend or terminate the account, and withdraw Professional status. The User may contest any measure by writing to contact@be-on-stage.com within 1 month; the Company reviews the measure and gives a reasoned reply. Abusive or repeated unfounded reports may themselves be sanctioned.

8. Intellectual property of the Platform

All the elements making up the Platform — structure, texts, graphic charters, logos, the BeOnStage trademark, databases, ranking algorithms and software — are the exclusive property of the Company or its rights holders. Any reproduction, performance or exploitation, even partial, without prior written authorization, is strictly prohibited. The music genres and occupations offered for selection are reference lists belonging to the Company.

10. Right of withdrawal and guarantees

10.1 In accordance with articles L.221-18 et seq. of the French Consumer Code, a User who is a consumer has 14 days from subscription to exercise their right of withdrawal, without having to give reasons for their decision.

10.2 As Premium access is provided immediately after subscription, the User is asked, before confirming the purchase, to expressly request immediate performance of the service and to acknowledge that their right of withdrawal is lost once the service has been fully performed (art. L.221-28 of the French Consumer Code). In the event of withdrawal during performance, the refund is reduced pro rata to the period already provided.

10.3 Refund requests for an in-app purchase are handled by Apple or Google according to their own procedures ("Report a Problem" on the App Store, order history on Google Play); the Company cannot process them itself. The User may nevertheless write to contact@be-on-stage.com with any complaint, and the Company will use its best efforts to assist them.

If Apple or Google grants a refund, access to the Premium plan and all its associated benefits is revoked and cut off immediately, without waiting for the end of the current subscription period.

10.4 Digital services benefit from the legal guarantee of conformity provided for in articles L.224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity, the User may request that the service be brought into conformity and, failing that, obtain a price reduction or the termination of the contract.

11. Term, suspension and termination

11.1 The Terms apply for an indefinite period for as long as the User has an account.

11.2 The User may delete their account at any time from the application. Deletion results in the immediate removal of their content, follows and interactions from the Platform, and the end of the license under article 6; the data is then retained and subsequently erased in accordance with the periods described in the Privacy Policy. The aggregated counters and statistics of other Users are not recalculated. Deleting the account does not in itself cancel an ongoing Premium subscription, which the User must disable from the store.

11.3 The Company may suspend an account as a precautionary measure under the conditions of article 7, or terminate the account in the event of a serious or repeated breach of these Terms, after informing the User in advance except in an emergency or where required by law. Suspension deprives the User of access to the application and makes their content invisible; it does not suspend billing of an ongoing subscription, and no refund is due to the User for the remaining period where the suspension or termination results from a breach attributable to them.

11.4 An account that has been inactive for more than 3 years may be deleted after notification to the account's email address.

11.5 Consequences of switching to Freemium status (downgrade rules)

When a Premium subscription expires without being renewed, or following an effective cancellation, the Artist account automatically switches to Freemium status. This change entails the immediate application of the following rules:

  • CLAPS balance: a conversion of the balance is offered before the switch. If the CLAPS are not converted, the balance is frozen and kept on the account without being deleted. It may be converted again upon resubscription to the Premium plan.
  • Exchanges and connections with Professionals: ongoing conversations with Professionals and pending connection requests are permanently closed. The Professional is informed.
  • Publications and quotas: the creation quota reverts to two publications per rolling 7-day period. Only publications made during the last rolling month under Premium status remain online.
  • Video live streams: any scheduled video live stream is automatically canceled, and registered Fans are notified.
  • Financial support (CLAPS): the ability to receive donations from Fans is blocked and the donation button is removed from the profile.
  • Advanced statistics and badges: access to detailed statistics is hidden (historical data is retained). The Premium and "Spotted by a professional" badges are removed from the profile.

12. Liability and force majeure

12.1 The Company is bound by an obligation of means as regards the availability and proper functioning of the Platform. It may interrupt access for maintenance or upgrade operations, while endeavoring to limit their duration and to inform Users. It applies rate limits designed to protect the service, which may temporarily block abnormal use.

12.2 The Company cannot be held liable for content published by Users, including live content, for relationships formed between Users (in particular between Artists and Professionals) on or off the Platform, for events announced by Users, or for the content of third-party websites and social networks accessible from the Platform.

12.3 Statistics, scores and rankings are provided for information only; they constitute neither a guarantee of visibility nor an assessment of an Artist's artistic value.

12.4 The availability of the application depends on the app stores and operating systems; the Company cannot guarantee compatibility with all versions or the continuity of distribution by these third parties.

12.5 The Company cannot be held liable where non-performance or delay results from a case of force majeure within the meaning of article 1218 of the French Civil Code, from a failure of the hosting, delivery or notification providers, or from administrative or regulatory restrictions. With regard to Professionals acting other than as consumers, the Company's liability is in any event excluded for any indirect damage, in particular any loss of profit, turnover, customers or business opportunity.

13. Personal data

The processing of personal data carried out in connection with the use of the Platform is described in the Privacy Policy, which the User declares that they have read before any registration or order. For reference, the Platform uses in particular the following processors: infrastructure hosting (to be completed: hosting provider ), file storage and video delivery (Cloudflare), sending of push notifications (Firebase Cloud Messaging, Google), sending of transactional emails (Brevo), sending of SMS (to be completed: SMS provider ), technical error monitoring (Sentry), website audience measurement (Matomo, hosted by the Company), and processing of in-app purchases (Apple, Google).

14. Complaints, mediation, applicable law and jurisdiction

14.1 For any information, question or complaint, the User may contact customer service: contact@be-on-stage.com (no dedicated phone line at present), or by mail to BE ON STAGE, 22 avenue Pierre 1er de Serbie, 75116 Paris, France.

14.2 If no amicable solution is reached within to be completed: timeframe , the consumer may refer the matter free of charge to the consumer mediator: to be completed: name, postal address and website of the designated mediator , or to the European online dispute resolution platform (ec.europa.eu/consumers/odr).

14.3 These Terms are governed by French law. Failing amicable agreement, the dispute will be brought before the competent courts; the consumer may, at their choice, refer the matter to the court of their place of residence or that of the Company's registered office. For Professionals acting in a professional capacity, exclusive jurisdiction is conferred on the courts of Paris.

14.4 These Terms are written in French. This English version is provided for information only; the French version prevails in the event of any discrepancy.
